Acceptance of terms

By downloading, installing or using WP AI Explainer (the "Plugin"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use our plugin.

Description of service

WP AI Explainer is a WordPress plugin that provides AI-powered explanations for website content.

We offer both free and premium versions of the plugin with different features and capabilities.

User responsibilities

When using our plugin, you agree to:

• Use the plugin in compliance with all applicable laws and regulations
• Provide accurate information when required
• Keep your login credentials secure
• Not attempt to reverse engineer, modify or redistribute the plugin
• Not use the plugin for any illegal or unauthorised purposes
• Respect the intellectual property rights of others

Licence and ownership

Free version

The free version of WP AI Explainer is licensed under the GPL v2 licence, the same licence used by WordPress. You're free to use, modify and distribute the free version in accordance with this licence.

Premium version

The premium version is proprietary software. Your licence gives you the right to use the plugin on your websites, but you may not redistribute, resell or share your licence with others.

Payment and refunds

Payment terms

Premium licences are billed annually through our merchant of record, who processes the sale, collects applicable taxes and issues your receipt. Payment is due at the start of each billing period. Prices are subject to change with 30 days' notice.

Refund policy

We offer a 7-day money-back guarantee for premium licences. Contact us within 7 days of purchase for a full refund. This is in addition to any statutory cancellation right you have as a consumer under UK law.

AI services and data processing

Our plugin uses third-party AI services to generate explanations. When you use these features:

• Text content may be sent to AI service providers for processing
• These services have their own terms of service and privacy policies
• You're responsible for ensuring your content complies with AI service provider terms
• We don't store or have access to the content processed by AI services

Service availability

We strive to provide reliable service, but we can't guarantee 100% uptime. The plugin may be unavailable due to maintenance, updates or circumstances beyond our control. We'll do our best to minimise disruptions and provide advance notice where possible.

Limitation of liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential or punitive damages, including but not limited to:

• Loss of profits, data or business opportunities
• Service interruptions or errors
• Third-party actions or content
• Costs of substitute services

Our total liability shall not exceed the amount you paid for the plugin in the 12 months preceding the claim. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including for death or personal injury caused by negligence, fraud or your statutory consumer rights.

Indemnification

You agree to indemnify and hold us harmless from any claims, losses or damages arising from your use of the plugin, violation of these terms or infringement of any third-party rights.

Termination

These terms remain in effect until terminated by either party:

• You may stop using the plugin at any time
• We may terminate your access if you violate these terms
• Premium licences terminate at the end of the billing period if not renewed
• Termination doesn't affect rights and obligations that accrued before termination

Complaints

If something has gone wrong, we would like the chance to put it right. Please email [email protected] with the subject line "Complaint" and a description of the issue. We aim to acknowledge every complaint within 5 working days and to provide a substantive response within 30 days.

If you are not satisfied with our response, you can escalate in writing to our registered office. UK consumers may also be entitled to take a complaint to an approved alternative dispute resolution body or, for online purchases, through the Citizens Advice consumer service at citizensadvice.org.uk. Complaints about how we handle personal data can be made to the Information Commissioner's Office at ico.org.uk.

Updates and modifications

We may update these terms from time to time. We'll give you at least 30 days' notice of any material change by posting the updated terms on our website and updating the "last updated" date. Your continued use of the plugin after changes take effect constitutes acceptance of the new terms.

Governing law

These terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, save that consumers resident elsewhere retain the benefit of any mandatory protections of the law of their habitual residence.

Severability

If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
